The parody, attribution and non-commercial aspects of Beatallica should constitute a strong ‘fair use’ defence under US Copyright law. Wondering whether the line “That’s the way I like it” in Ben Lee‘s song Catch My Disease is intended as a direct reference to Magic Dirt‘s Dirty Jeans. I can’t be the only person thinking this? It’s the most prominent line in both songs. There’s no way that Lee wouldn’t be familiar with the Magic Dirt song. Both songs also feature hand claps as rhythmic backing. Ostensible contradictions between two writers’ theories of culture & copyright lead to the finding of common ground. Conclusion is that Creative Commons is good because ‘remix culture’ is the future. Duh – it’s the past, present and future! Show me an idea (or its expression) that isn’t a synthesis (or ‘remix’) of previous ideas. |
